Adjudication

Adjudication is a new development in Malaysia following the coming into force of the Construction Industry Payment and Adjudication Act 2012 in April 2014.

Nahendran was one of the first adjudicators to receive accreditation from the KLRCA, the default appointing authority under the Act.

Adjudication has received wide acceptance in the UK and Australia, and is expected to become a well-established dispute resolution mechanism in Malaysia. Adjudication will cover disputes in connection with construction, installation, maintenance and repair for buildings, roads, drainage, mechanical, electrical and telecommunications works (save for some statutory exceptions).

Recognizing the importance of cash flow and work progress, procedures adopted in the adjudication will be kept as simple as circumstances permit and time will be managed carefully to ensure that a swift but fair and careful determination is made within the time frames stipulated in the Act.
