Arbitration

Our Chambers has wide experience appearing before arbitral tribunals. Nahendran is also a Chartered Arbitrator and sits as sole arbitrator and in panels of three, and has experience sitting both as co-arbitrator and as Chairman. Nahendran has received numerous party appointments as well as institutional appointments from the Kuala Lumpur Regional Centre for Arbitration (KLRCA), Singapore International Arbitration Centre (SIAC), the Malaysian Bar and the ICC International Court of Arbitration.

Arbitrations are conducted either at Chambers or at other venues such as the KLRCA, Bar Council, Malaysian Institute of Arbitrators or any venue chosen by the parties.

Nahendran has conducted arbitrations in commercial contracts, construction, insurance and company law disputes and is well-versed with documents-only arbitrations, arbitrations with expert evidence, baseball arbitrations and arbitrations with the aid of assessors.

Nahendran’s approach to arbitrations is flexible. Each arbitration is evaluated at an early stage and parties are encouraged to explore different alternatives for determining the dispute efficiently and effectively, including consideration of whether the approach should be inquisitorial or adversarial. Attention is also given to controlling costs, in particular the arbitrator’s own costs. To this end, fast track arbitrations are also given consideration.
